The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This comes after a court battle that questioned her eligibility to serve.
Acceptance of Resignation
US Attorney General, Pam Bondi, accepted her stepping down on Monday. She commented that the appeals court finding made it unworkable for her to perform her duties.
"Let no one confuse adherence to the ruling as defeat," Habba stated. "My fight will now reach across the nation."
Legal Background
Habba's exit follows closely on a judicial panel ruled that she had been serving in violation of the law as US attorney. This decision is likely to affect numerous prosecutions in the state.
The court said that a temporary posting that skirted Senate approval violated the Federal Vacancies Reform Act.

The Attorney General added that the former prosecutor will continue working within the DOJ as a senior adviser. Habba plans to challenge the decision of the ruling, in the hope of achieving a reversal.
Writing online, she contended that the court "cannot be permitted to override the President's choice of lawyers entrusted with performing the executive branch's core responsibility of criminal prosecution."

She commended Habba's record and noted that under her leadership, the city of Newark saw a 20% reduction in criminal activity. Additionally that the Camden recorded its first summer in 50 years without a homicide.
Background and Previous Role
The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in 2021. Subsequently, she represented the former president in his hush-money trial in New York last year, which resulted in his conviction on multiple felony counts of financial record manipulation.
Earlier, her appointment to the federal prosecutor position, Trump had revealed he was selecting her as his presidential counsellor if re-elected, calling the lawyer as deeply loyal and a "tireless advocate for justice".
