Federal Court Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to answer human smuggling allegations, he was detained in federal detention.

In her decision, the court pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
